Speaker Disallows Adjournment Motions on Waqf Amendment Bill Citing Sub-Judice Rule

Jammu | April 7, 2025:
In a significant development, Speaker of the Jammu and Kashmir Legislative Assembly, Abdul Rahim Rather, today disallowed two adjournment motions submitted by nine members seeking to discuss the Waqf Amendment Bill, 2025.

The Speaker cited Rule 58(vii) of the Assembly Rules, which prohibits debate on matters currently under judicial consideration, as the Waqf Amendment Bill has been challenged before the Supreme Court of India.

“Since the Waqf Bill is now under adjudication in the Supreme Court, I cannot allow discussion in this House as per legislative rules,” Speaker Rather announced while dismissing the motions.

However, the Speaker’s decision sparked strong objections from several lawmakers. Some pointed to the Tamil Nadu Legislative Assembly, which recently passed a resolution opposing the same Waqf Bill, questioning why the J&K Assembly couldn’t do the same.

Responding to the objections, the Speaker clarified:

“At the time when Tamil Nadu passed their resolution, the matter was not sub-judice. The current situation in J&K is legally different.”

The ruling has added a new layer of controversy to the ongoing debate surrounding the Waqf Amendment Bill, which has drawn sharp criticism from political leaders and civil society alike for allegedly undermining minority religious rights and Waqf autonomy.
