
J&K High Court Grants Final Chance to Centre in MLA Nomination PIL, Next Hearing on July 25
Jammu, April 30:
The Jammu and Kashmir High Court’s Division Bench, while hearing a public interest litigation (PIL) challenging the nomination of five MLAs, has given the Government of India a final four-week opportunity to submit its reply. The court has now scheduled the case for final hearing on July 25.
The PIL was filed by former MLC and senior JKPCC leader Advocate Ravinder Sharma, questioning the authority of the Lieutenant Governor to nominate five members to the Legislative Assembly. The matter came up before a special Division Bench comprising Justice Sanjeev Kumar and Justice Rajesh Sekhri.
During the proceedings, the petitioner’s counsels, Advocate D.K. Khajuria and Advocate Shah Mohammed Chaudhary, informed the court that the Union of India had failed to file its reply despite repeated opportunities. They requested the court to close the respondents’ right to reply and proceed with a final hearing.
However, Additional Solicitor General of India (ASGI) Vishal Sharma stated that the government’s draft reply was ready and asked for a final opportunity to file it. In response, the petitioner’s counsels also requested the right to file a rejoinder if necessary.
The court then granted the Union of India a last and final four-week period to file its reply, followed by another four weeks for the petitioner to submit a rejoinder. The matter has now been listed for final hearing on July 25, 2025.
Senior AAG Mohsin Qadri, Senior AAG Monika Kohli appeared on behalf of the Union Territory administration, while Advocate S.S. Ahmed represented the applicant-intervenors.
